Company-status note. Until Operanics Group is incorporated, the legal operator identified on invoices or payment records is the contracting party for paid services.
1. Acceptance
By installing or using Opendot, you agree to these Terms.
2. Service limitations
Tracking depends on recipients' email clients loading images. Results may be delayed, incomplete, duplicated, or unavailable and are not proof that a particular person read or understood a message.
3. Accounts
You must provide accurate information, protect your credentials, and report suspected unauthorised use.
4. Plans and billing
Features, limits, and prices are described on the website or checkout page. Paid subscriptions may renew monthly or annually. You may cancel before the next renewal date; cancellation normally takes effect at the end of the current paid period.
5. Refunds
Except where required by law, fees already charged are generally non-refundable and unused time is not prorated. See Refund Policy.
6. Acceptable use
You must not use Opendot for spam, phishing, malware, fraud, unlawful surveillance, harassment, stalking, or communications that violate privacy, employment, marketing, or consumer-protection law. You must not bypass limits, interfere with the service, access another user's data, or test security without permission.
7. Your responsibilities
You are responsible for deciding whether tracking is lawful and appropriate in your circumstances and for providing any required notice or consent.
8. Intellectual property
Opendot software, branding, design, and documentation are owned by or licensed to the operator. You receive a limited, revocable, non-transferable right to use the service for its intended purpose.
9. Availability
We aim for reliability but do not guarantee uninterrupted availability. We may update, suspend, or discontinue features for security, legal, operational, or product reasons.
10. Suspension
We may suspend or terminate accounts that present security, fraud, abuse, legal, or non-payment risk.
11. Disclaimers and liability
To the maximum extent permitted by law, Opendot is provided “as is” and “as available.” Nothing excludes rights that cannot lawfully be excluded. For paid plans, aggregate liability will not exceed the amount paid for Opendot during the 12 months before the event giving rise to the claim.
12. Governing law
These Terms are governed by New Zealand law, subject to mandatory rights in your location.
